PsyStar may use 'anti-trust' defense
August 4th 2008
ComputerWorld reports that lawyers hired by PsyStar to defend it against a lawsuit brought by Apple over the clone makers use of OS X are getting to set out their approach.
"This case has been mischaracterized," said Colby Springer, a lawyer with Carr & Ferrell. "There are a lot more complicated issues than just copyright or trademark. There are more complex issues [than those] in respect to the end-user licensing agreement. And, antitrust issues come into play, too."
ComputerWorld quotes a number of legal experts that are mostly dismissive of PsyStar's approach and if you need that, it's there.
However, the question I have about PsyStar's defense is, "Who's paying for it?" I sincerely doubt they've sold or will ever sell enough computers to pay Carr & Ferrell, which is a very high-profile and, one assumes, extremely expensive firm.
Who's their sugar daddy?
